PhyleTec, Inc.  (“PhyleTec”, “the Company”, “we”, “our”, “us”) is committed to protecting the privacy of individuals who visit the Company’s websites (“Visitors”) and individuals who register to use the Services as defined below (“Customers”). This Privacy Policy describes PhyleTec’s privacy practices in relation to the use of the Company’s websites and the related applications and services offered by PhyleTec (the “Services”).

PhyleTec is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf.  We comply with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, we are subject to the regulatory enforcement powers of the U.S. Federal Trade Commission.  In certain situations, we may be required to disclose personal data in compliance with applicable law or in response to requests by proper legal or governmental authority including, without limitation, meeting national security and/or law enforcement requirements.

PhyleTec, Inc. collects information under the direction of its Customers while on www.PhyleTec.com. PhyleTec, Inc. has no direct relationship with the individuals whose personal data it processes and works with its Customers to help them provide notice to their users concerning the purpose for which personal information is collected and stored.

We collect, process, and store the following personal information collected by and sent to us by our Customers:

  • Contact information such as name, email address, mailing address, phone number
  • Employee information
  • Supplier and vendor information
  • Unique Identifiers such as user name and password, We also collect, process, and store the following non-personal information collected by and sent to us by our Customers:
  • Information about your business such as company name, company size, business type
  • Information about company business orders or other transactions

PhyleTec.com Public Website (“PhyleTec.com”)

PhyleTec, Inc. collects certain information through its public website at PhyleTec.com. We collect information about the pages served to you as an anonymous user for the purpose of aggregate site statistical data collection and analysis. Additionally, PhyleTec, Inc. offers a series of resources available to Visitors for download but requires the Visitor to enter certain personal information prior to download. Information collected through this process includes, without limitation, name, email address, job title, business phone number, company name, industry, location and comments, if left by the user.

PhyleTec, Inc. uses the information collected (as described above) to:

  • Contact Visitors of PhyleTec.com who downloaded content regarding interest in our services
  • Obtain information about site navigation and performance and analytical metadata regarding the overall site usage

Regarding the PhyleTec, Inc. software platform, we collect information for our Customers. If you are a customer of one of our Customers and would no longer like to be contacted by one of our Customers that use our service, please contact the Customer that you interact with directly. If you are a Customer and would like to update your account information please contact us privacy@PhyleTec.com or 248-634-4000. Regarding Visitors to our public website at PhyleTec.com, we will not collect any personal information you do not volunteer. All requests will be responded to within 45 days.

  1. Service Provider, Sub-Processors/Onward Transfer

For Customer users of the PhyleTec, Inc. software platform, PhyleTec may transfer personal information to companies that help us provide our services. Transfers to subsequent third parties are covered by the provisions in this Privacy Policy regarding notice and choice and the service agreements with our Customers. We may provide your personal information to companies that provide services to help us with our business activities such as, but not limited to, customer service requests, customer-reported system issue resolution, provision of third party services including software services, and participation in our user community (“PhyleTec Community”). These companies are authorized to use your personal information only as necessary to provide these services to us.

PhyleTec, Inc. Public Website

Regarding PhyleTec’s public website (PhyleTec.com), PhyleTec may provide third parties with aggregate statistical data about our Customers and Visitors, traffic patterns, and related site information. This data reflects site usage patterns gathered during thousands of Customer and Visitor visits to our website each month but does not contain behavioral or identifying information about any individual, unless that individual has given us permission to share that information. We may also provide log files and other databases of user information to third parties for analysis, so we can get a better understanding of traffic through our site and improve our content offerings. PhyleTec also may use third party companies to provide delivery of e-mail newsletters and other messages over e-mail. If you would like to discontinue receiving this information, you may update your email preferences by using the “Unsubscribe” link found in emails we send to you or at your member profile on our website or by contacting us at privacy@PhyleTec.com.

Additionally, PhyleTec, Inc. may uses one or more third party advertising companies to present ads when you visit our websites. The advertising companies may use information about your visits to our and other websites in order to provide advertisements about goods and services of interest to you. In addition, for the purpose of managing and targeting advertisements on our websites, we share with third party advertising companies certain website usage information about Visitors to our websites. Also be aware that we may buy and sell business assets and/or divisions; customer information is generally part of such a sale. Our websites may include social media features such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on the website, and may set a cookie to enable the feature to function properly. Social media features and Widgets are either hosted by a third party or hosted directly on our websites. Your interactions with these features are governed by the Privacy Policy of the company providing it.

Data Controlled by PhyleTec Customers – PhyleTec Software Platform

PhyleTec has no direct relationship with the individuals whose personal data it processes through the PhyleTec software platform. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct such query to the PhyleTec Customer (the data controller). If the Customer requests PhyleTec to remove the data, we will respond to the Customer’s request within 30 business days.

Data From Visits to PhyleTec.com

Any personal data entered by the Visitor on PhyleTec.com is entered directly by the individual. If the Visitor wants to request changes or deletion of such data, the individual should contact PhyleTec at privacy@PhyleTec.com or 248-634-4000. Upon request, we will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. All requests will be responded to within 30 days. We may retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes, and/or enforce our agreements.

PhyleTec and its partners use cookies or similar technologies to analyze trends, administer the PhyleTec websites, track users’ movements around the websites, and gather demographic information about our user base as a whole. Log Files

For Customer users of the PhyleTec software platform, PhyleTec automatically gathers certain information and stores it in log files. This information may includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. PhyleTec may uses this information, which does not identify individual users, to analyze trends, administer the websites, track users’ movements around the websites, and gather demographic information about our user base as a whole.

The security of the information we process on behalf of our Customers is very important to us. When you enter sensitive information (such as login credentials), we encrypt the transmission of that information using secure socket layer (SSL) technology.

We follow generally accepted security standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. PhyleTec, Inc. will retain your information and the personal data we process on our Customers’ behalf for as long as your account is active or as needed to provide you services.  We will retain and use this information as necessary to comply with our legal obligations, resolve disputes, and/or enforce our agreements.

  1. Material Change:

We may update this Privacy Policy to reflect changes to our information practices and procedures and comply with applicable law and regulations. If we make any material changes, we will notify all affected Customers by email (sent to the email address specified in your account) or by means of a notice posted on the PhyleTec, Inc. software platform prior to the change becoming effective. We encourage you to periodically review this Privacy Policy for the latest information on our privacy practices.
